Protocols and rules

Arbitration should not be simply private litigation. For that reason, we have developed rules that drive our process. Our full rules are compliant with all commercial arbitration requirements. However, they have been drafted to assure time- and cost-efficiency without sacrificing the quality or fairness in the proceedings. Here are a few examples:

  • Expedited Measures
    Beginning with the initial conference, the arbitrator will identify and implement expedited approaches to the gathering and presenting of evidence that will effectively reduce both the cost and time required to reach resolution, consistent with justice. click to see full rules
  • Presentation of Voluminous Documentary Evidence
    Any business, financial or health care records exceeding 500 pages fall under this rule. Summaries are used in lieu of full documentation. Due dates and review periods are pre-established. click to see full rules
  • Presentation of Voluminous Deposition Testimony
    Any deposition exceeding 100 pages fall under this rule. Summaries of depositions will be admitted for review and will not exceed ten pages in length. Due dates and review periods are pre-established. click to see full rules

Case Flow

In combination with our rules, our case flow establishes the backbone of our efficiency. While the following does not cover every possible scenario, it does, in general, reflect both the intent and the spirit of how we operate.



Technologies

Extensive use of Teleconferencing
Through a special arrangement with Esquire Deposition Services, we are able to provide teleconferencing facilities to the parties at a reduced cost. The extensive costs associated with air travel, hotel and meal expenses are significantly curtailed through the use of this technology. Through our relationship with Esquire, we have also obtained reduced rates for depositions and reporting of the arbitration hearing itself.

Web-based communication and case updates
While currently in development, Conflict Solutions will soon enable systems that allow parties to a conflict to view and print updated status, reports and costs relating to their case. This further reduces expense related to printing, faxing, sending and storing documents, while also achieving a near real-time communication facility.
